Terms of Service

These Terms of Service (“Terms”) govern your use of pitchsmith.tech and the Pitchsmith service (the “Service”). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Service scope

Pitchsmith takes a messy startup idea you provide and generates an honesty-first one-pager guide and audit report using the Anthropic (Claude) API. The Service is provided on an as-is basis and may change, be limited, or be discontinued at any time. Generation runs entirely on our servers using our own API key.

2. Eligibility (18+)

You must be at least 18 years old to use the Service. By using Pitchsmith you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms.

3. Acceptable use

You agree not to:

submit content that is unlawful, infringing, defamatory, or that violates the rights of others;
attempt to extract our API keys, credentials, or other secrets, or probe, scan, or circumvent our authentication, rate limits, or billing;
use the Service to generate content that violates Anthropic’s usage policies;
resell, scrape, or abuse the Service, or use it to build a competing product through automated bulk access.

4. Accounts and payments

You are responsible for activity under your account and for keeping access to your email secure, since sign-in is by magic link. Paid credits are consumed per generation as described at purchase. Except where required by law, purchases are non-refundable.

5. Intellectual property in generated content

As between you and Pitchsmith, you own the pitch inputs you submit and the one-pager and audit outputs generated for you, subject to Anthropic’s applicable terms. We claim no ownership over your inputs or outputs. You are responsible for how you use generated content. The Pitchsmith name, software, and design remain our property.

6. Disclaimers

The Service and all generated content are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. AI-generated output may be inaccurate, incomplete, or unsuitable for your purpose. It is not legal, financial, or investment advice, and you should independently verify it before relying on it.

7. Limitation of liability

To the maximum extent permitted by law, Pitchsmith and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $50.

8. Changes

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
